These terms and conditions of sale are entered into by DOCTEUR FILLER, a company with share capital of €1,000, headquartered in Marseille, France, registered with the Marseille Trade and Companies Registry under number 905142675 under number 905 142 675, hereinafter referred to as ‘DOCTEUR FILLER’, which manages the Docteurfiller.fr website, and by any individual or legal entity wishing to make a purchase via the docteurfiller.com website, hereinafter referred to as ‘the buyer’.

Article 1. Purpose

These terms and conditions of sale are intended to define the contractual relationship between Docteur Filler and the purchaser, and the conditions applicable to all purchases made through the docteurfiller.com website. The acquisition of a product through this website implies the buyer’s unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the docteurfiller.com website is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to commit himself under these general conditions of sale.

Docteur Filler reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its website. As a result, the applicable conditions will be those in force at the date of the buyer’s order.

Article 2. Products

The products offered are those shown on Docteur Filler’s docteurfiller.com website, while stocks last. Docteur Filler reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible, but are not binding on the Vendor. The sale of products presented on the docteurfiller.com website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Rates

The prices appearing on the product sheets of the internet catalog are in Euros (€) and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Docteur Filler reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In metropolitan France, shipping is free for orders of 100 euros or more, inclusive of tax; for orders of less than 100 euros, inclusive of tax, the buyer will be billed a flat-rate shipping charge of a variable amount.

Article 4. Order and payment terms

Before placing an order, the purchaser must create an account on the docteurfiller.fr website. The account creation section can be accessed directly from the side menu bar. Each time you visit the site, if you wish to order or consult your account (order status, profile, etc.), you must identify yourself using this information. Docteur Filler offers the buyer the option of ordering and paying for its products in several stages, with 3 payment options to choose from:

Payment by cheque: the buyer selects the products he/she wishes to order in the “shopping basket”, modifies them if necessary (quantities, references…), checks the delivery address or enters a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: “Payment by cheque”. In the last step, the buyer is asked to check all the information, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the “Confirm my order” button. This last click constitutes the final conclusion of the contract. As soon as the order has been validated, the buyer receives an order form confirming that the order has been registered. In order to finalize payment and process the order, the buyer must print out the order form and send it, together with a cheque made payable to “Docteur Filler”, to the following address: Docteur Filler 258 BD NATIONAL 13003 MARSEILLE. No cash payment should be sent. Only cheques issued by a French bank will be accepted. As soon as the cheque is received, the order will be processed and the buyer will be informed by email. Docteur Filler will ship the products at the earliest 2 working days after cashing the check corresponding to the order, subject to provisions.

Payment by bank transfer: the buyer selects the products he wishes to order in the “shopping basket”, modifies them if necessary (quantities, references…), checks the delivery address or enters a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: “Payment by bank transfer”. In the final step, the purchaser is asked to check all the information, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the “Confirm my order” button. In order to finalize payment and process the order, the buyer must contact his/her bank to transfer the amount of the order to Docteur Filler’s bank account, the details of which are communicated to the buyer. As soon as the transfer is received, the order will be processed and the buyer will be informed by e-mail. Docteur Filler will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one’s own terms and conditions of purchase. All data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has provided it on the order form, the company . Article 5. Reservation of title

Article 6. Withdrawal

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area.

The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

7.2.5. International delivery :

Chronopost also offers international delivery services. Delivery times and costs for international shipments will be calculated according to the destination and characteristics of the parcel.

7.2.6. Absence on delivery :

If you are absent at the time of delivery, Chronopost will leave a delivery notice and your parcel will be dropped off at the nearest Chronopost agency. You can collect your parcel by showing proof of identity and the delivery notice.

7.2.7. Complaints and returns :

7.3 Delivery by Chrono Relais

7.3.1. Delivery methods :

We offer delivery of your orders via Chrono Relais. This service enables you to receive your products quickly and safely at a relay point of your choice, close to your home or workplace.

7.3.2. Delivery time :

Delivery times by Chrono Relais are generally between 24h and 48h for national deliveries, depending on your location and the selected relay point. Please note that these times are indicative and may vary according to busy periods, weather conditions or possible health restrictions.

7.3.3. Selecting the relay point :

When validating your order, you will be able to choose the Chrono Relais point that is most convenient for you. A list of available points will be displayed according to your delivery address.

7.3.4. Order tracking :

As soon as your order has been dispatched, you will receive a confirmation email containing a tracking number. You can track your parcel in real time on the Chronopost website(www.chronopost.fr).

7.3.5. Notification of availability :

When your parcel arrives at the chosen relay point, you will be informed by email and/or SMS. You will then have 7 to 14 days to collect your parcel, depending on the conditions at the relay point.

7.3.6. Package recovery :

To pick up your parcel, please present yourself at the relay point with an ID and the tracking number or the notice of availability received by email/SMS.

7.3.7. Cost of delivery :

Chrono Relais delivery charges are calculated according to the weight and dimensions of your parcel. The exact cost will be displayed when you confirm your order.

7.3.8. Complaints and returns :

If you have any problems with the delivery (damaged parcel, delay, etc.), please contact our customer service department as soon as possible. We will work with Chronopost to resolve the problem and ensure your complete satisfaction.

7.4 Delivery by Mondial Relay

7.4.1. Delivery methods :

We offer delivery of your orders via Mondial Relay. This service enables you to receive your products quickly and securely at a relay point of your choice, close to your home or workplace.

7.4.2. Delivery time :

Delivery times by Mondial Relay are generally 3 to 5 working days for national deliveries, depending on your location and the selected relay point. Please note that these times are indicative and may vary according to busy periods, weather conditions or possible health restrictions.

7.4.3. Selecting the relay point :

When validating your order, you will be able to choose the Mondial Relay point most convenient for you. A list of available points will be displayed according to your delivery address.

7.4.8. Complaints and returns :

If you have any problems with the delivery (damaged parcel, delay, etc.), please contact our customer service department as soon as possible. We will work with Mondial Relay to resolve the problem and ensure your complete satisfaction.

Article 8. Warranty

All products supplied by Docteur Filler are covered by the legal warranty stipulated in articles 1641 et seq. of the French Civil Code. In case of non-conformity of a sold product, it can be returned to Docteur Filler who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address: Docteur Filler 258 BD NATIONAL 13003 MARSEILLE, within thirty days of delivery.

Article 9. Liability

Docteur Filler, in the process of distance selling, is only bound by an obligation of means. The company cannot be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
